1. Terminology

Please make yourself aware of the following terminology.

Data - means information which is being processed by means of equipment operating automatically in response to instructions given for that purpose, is recorded with the intention that it should be processed by means of such equipment.

Public Data - Data that is included on RateAFace.com for all to see. All Public Data is given under no force. Users do not need to enter any Public Data. Contact details are considered Personal Data, unless requested to be made public to Advanced Users of RateAFace.com.

Personal Data - Data that is relevant to the user only, such as name, contact details including but not limited to phone numbers and e-mail addresses. Personal data is asked for, but in some cases not required. Under most circumstances, personal data will not be visible to the public. However this is entirely up to the individual user.

Sensitive Personal Data - Data which is considered sensitive is not forced out of Users. This includes political, religious, sexual or legal views, the user's health, mental or physical, and any occupational details.

Data Controller - A trusted administrator or moderator who has access to limited Personal Data, such as contact details and usage stats, and also has access, if need arises, to user posting machine data, which includes IP address and recent browser type and posting location.

2. About RateAFace

RateAFace is a photo rating and sharing community, which incorporates public profiles, public images uploaded from a user's local machine and an open commenting system.

RateAFace allows users to either compete in the daily rankings table, share their pictures and openly talk to, and rate other users.

For the purpose of building a profile, certain information can be saved into our system, however most Data is voluntary and is not required.

The limited information that is collected and is required apon signup, by the RateAFace includes: a choice of username and password, active and valid contact e-mail address, date of birth, gender, country of residence, and a name (such as a first name). This required information is to build the user account, allowing other users to see simple information about who the user is. However date of birth is considered Personal Data, and is treated as such.

The contact e-mail address given to our system is Personal Data. However additional contact Data can be saved to a user's account via their control panel. This Data is, if requested, made to be Public Data. However by default, these contact details are hidden and considered Personal Data.

Voluntary Sensitive Personal Data can be saved to a user's profile account, however is not requested nor required by our system. This Data is only to allow additional parameters to be present whilst searching for, or contacting new possible online "friends".

If any Data on a user's personal profile is considered offensive, discriminant or too revealing (ie, postal address/phone number) a Data Controller can, and will remove this information apon discovery or request.

All Public Data on a user's profile is controlled exclusivly by the user in all aspects of visibility, extent, details and legitimacy of this Data.

3. Information Collection and Use

When a user registers with RateAFace.com they are asked to supply limited Personal Data. This is required to create an account. Public Data supplied is completly up to the user. All private data is stored privatly, however Data Controllers have access to this information if needed. ie a legal situation arises, complaints, parental concerns etc.

The information obtained during the registration process is used to create your own unique identification as a site services user and enables us to undertake the various administration processes necessary.

This identification is provided in the form of a member name and password. It is important that you keep this identification secret to avoid unauthorized use of your account. The initial e-mail address supplied during the signup process is also very important to keeping your login details, as this is used to restore your account if the password is lost, or stolen.

The information we collect about you and/or your business enables us to:

  • Understand your needs
  • Improve our service to you
  • Stay in touch with you through other media as you require
  • Deliver goods and services to the addresses you have provided
  • Enhance and refine existing information we may have acquired from other sources
  • Complete the internal administration necessary to register you and maintain our service to you.

Detailed information about you is only collected when you are advised explicitly that is what we are doing and you supply it voluntarily.

With exception to general user geographic location(s) and age groups, we will not share any Data with sub-contractors and/or partners. Any Data that is transmitted via secure connections to any partners or sub-contractors will only be on condition that they comply strictly with our own Terms and Conditions, the Privacy Policy you are currently reading and the EU Directive on Data Protection and the Data Protection Act 1998.

You can check the accuracy of our records and make modifications at any time in the 'My Controls' settings area. You can immediately delete any information we hold about you by using the facilities in your "Settings" user Control Panel. But please remember that deletion of key information may affect your status as a registered user.

When approached by the appropriate authorities, information about you, your business or account usage may be disclosed but only when legally required under European Law. We take all reasonable precautions to protect information about you from loss, misuse and alteration. Data Controllers, partners and sub-contractors who have access to your information have a duty of care as detailed in our contracts with them and are not permitted to use it for any other purpose unless you have given your explicit permission in detail that they may do so.

Manual destruction of files, records and computer print-outs containing sensitive data are carried out in a secure way by either internally shredding or using a supplier who uses secure disposal methods.

Registration details are very important - please keep your password and member name secret. It is better for other users to register separately than to share your account access information.

We will never write to ask for your login details - be cautious of anyone asking for this information. Some non-personal information may be collected automatically, such as the computer operating system and the type of browser software you are using, along with special server-side codes that tell us which pages you have visited, for use in referal and page logging.

Some information is stored in the form of a 'cookie', a small file which remains on your computer but which acts as a reminder about any preferences you have selected when visiting our sites. We only use 'cookies' to improve our service to you.
We may also store your log in username on your computer, but only if you explicitly request us to do so. Remember that if you opt for us to do this, any other user of the same computer can access your account. You can delete this 'cookie' by clicking the Log Out link at the top of any page.

4. Image Collection and Use

The term "You" refers to you, the user, reading this policy before the upload procedure.

All images uploaded are entirely voluntarily, and you must abide by our terms and conditions for all images.

Images are stored on our private servers in either the United States or the United Kingdom. Images become available to registered members of the public straight after upload.

If an image is found to be not suitable, it will be removed. See our Terms and Conditions for more information.

5. Email Opt-Out

When a user of RateAFace invites their friends via our automated invite a friend, an e-mail message is sent to the user's contacts selected from their contact list.

If recipents do not wish to recieve these invitations, they are able to opt-out via the following URL:

Users who recieve alert messages from our system, can change these settings from their account notification settings via their user control panel.

6. Changes in Our Privacy Policy

We reserve the right to change this statement at any time without warning to meet any statutory requirements or changes in the nature of our activities and services. This privacy statement does not form the basis of any contract between any party. We caution you against giving out personally identifiable information (such as social security numbers, credit card numbers, names and addresses, driver license numbers, passwords) to strangers online, which may be used for illegal or harmful purposes.
